Terms and conditions of sale

 

Preliminary provisions

The present conditions cancel and replace the previously applicable conditions and govern the relationship between our company and its customers. All other documents issued by our company, in particular catalogs, prospectuses and advertisements, are for information purposes only.

 

Terms of delivery

Deliveries are made by handing over the goods to the postal service or a carrier at our company's premises. Goods are always transported at the recipient's risk, even when prices are set as carriage paid. In the event of damage or missing items, it is therefore the recipient's responsibility to make clear and precise reservations on the delivery note and to confirm these to the carrier by registered letter with acknowledgment of receipt within a maximum of 48 hours. A copy of this letter must be sent to us. Without this procedure on the part of the customer, our company will not be able to respond to the complaint. The return of packages for any reason whatsoever is exclusively at the customer's expense.

If you are absent or do not respond to text messages and calls from the carrier during delivery after an appointment has been made, additional fees will apply for the new delivery.

In the event of non-payment of these additional costs, we reserve the right to suspend shipment of future orders.

 

Price

Our prices are those in force at the time of the quotation or order. They may nevertheless be modified at any time, subject to 7 days' notice, particularly in the event of a significant change in the cost of raw materials.

Returns

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be resold as new.

Damaged, soiled, or incomplete products will not be accepted for return or exchange.

The customer is responsible for return shipping costs within a maximum period of 14 days after notifying us of their decision to return the item.

Terms of payment

Our goods are payable at our registered office, by the method of payment and on the date stipulated on the invoice. In the event of payment by bill of exchange, if the bill has not been returned by the due date, payment will be made by cheque or bank transfer. Failure to pay a single invoice by the due date shall render all subsequent invoices due and payable immediately. Following notification by registered letter, our company may suspend shipment of other goods ordered by the customer, without prejudice to any damages which our company reserves the right to claim at a later date. Any payment made after the due date stipulated on the front of the invoice will incur late payment penalties calculated on the basis of the legal interest rate in force plus 3 points, without the need for formal notice, with a minimum of €40 per invoice. In the event of cancellation of an order, the customer may not recover the amount of the deposit paid. In application of law no. 80-335 of 12/05/1980, the goods sold by our company remain its property until full payment of the price in principal, costs, interest and accessories by the customer. The transfer of ownership of the goods sold is subject to payment of the price by the customer on the due date. However, the risks of the goods are transferred to the customer upon delivery. Goods in stock at the customer's premises are presumed to be unpaid. In the event of resale of the goods by the customer, either as is or after transformation, the customer undertakes to transfer to our company the price paid by the sub-purchasers up to the amount of the price of the goods remaining unpaid. In the event of non-payment, our company, without losing any of its rights, may demand by registered letter with acknowledgement of receipt the return of the goods at the customer's expense and risk. The customer shall also bear any legal and judicial costs.

Reservation of ownership

Pursuant to Law No. 80-335 of May 12, 1980, goods sold by our company remain its property until full payment of the principal price, costs, interest, and incidental charges by the customer. Transfer of ownership of the item sold is subject to payment of the price by the customer on the due date. However, the risks associated with the goods are transferred to the customer upon delivery. Goods in stock at the customer's premises are presumed to be unpaid. In the event of resale of the goods by the customer, either in their original state or after processing, the customer undertakes to transfer to our company the price paid by the sub-purchasers up to the amount of the price of the goods remaining to be paid. In the event of non-payment, our company, without losing any of its rights, may demand by registered letter with acknowledgment of receipt the return of the goods at the customer's expense and risk. The customer shall also bear any legal and judicial costs.

Warranty

The warranty is limited to the repair of equipment recognized as defective under the warranty conditions, which are the only ones applicable in all cases, subject to normal storage conditions and duration, as well as installation and maintenance as prescribed by our company and "in accordance with best practices." No returns can be made without our prior agreement. The warranty covers parts and labor in our workshops against all manufacturing defects or faults.

 

 

Jurisdiction

In the event of any dispute, French law shall be exclusively applicable and the Bobigny Commercial Court shall have sole jurisdiction, regardless of the conditions of sale and the agreed method of payment, even in the event of summary proceedings, multiple defendants or plaintiffs or warranty claims.
